Terms and Conditions

Our users’ privacy and safety is very important to the WA Department of Transport. This document outlines the Terms and Conditions and a code of conduct that users on the Your Move website agree to in order to help us protect the safety and privacy of users and other persons who may interact with the website.

The Your Move website is an online community that is built on creativity and trust. We embrace creative expression; however, we must try to maintain an environment that is safe, positive, and welcoming to our current and future users. To do this, the Department actively monitors user behaviour and content on the website. Any content or behaviour that, in our judgment, violates these Terms and Conditions, or that may harm users or other persons (including organizations’ or associations) may be edited or removed from the website. If necessary, the Department may delete a user’s profile or take other action to protect other users or persons, including reporting offending content or behaviour to the relevant authorities.

Privacy and Content Distribution

  1. Unless I have received prior written consent, I will not post content that violates any person’s privacy, including personally identifying adults or children in photographs, or providing confidential information like phone numbers, email addresses, credit card numbers, or unlisted contact information.

  2. I understand the WA Department of Transport (Department) may take immediate action on any account, including any account established by me, that it believes to be using the Your Move website to share or distribute private data.

  3. I am responsible for obtaining prior parental or guardian consent to use images of their children via the standard school model release form that parents elect to sign at the start of each school year.

  4. I understand that the Department and the Your Move website’s creators or operators are not responsible for the text, images and video content that I upload to the Your Move website.

  5. I will not copy or distribute photographs or other personally identifying information of adults or children on the Your Move website.

  6. I will always ensure that the content I upload to, or download from, the Your Move website aligns with my organisation’s commitment to privacy and online safety.

  7. I understand that that material I post to the website is authorised to be reproduced by other authorised website users, provided such reproduction is used only in connection with use of the Your Move website. Any reproduction of user material posted to the website outside the Your Move online community may be subject to action for copyright infringement.

Personal Safety

  1. I will not establish or register a username or account associated with the Your Move website for the purpose of impersonating an individual, organisation, or brand to groom and/or victimise any user or other person.

Online bullying

  1. I will treat others online with the same respect that I do in person and agree not to use the Your Move website platform for online bullying and/or trolling by posting inappropriate or disparaging comments to other users.

Insurance

  1. I understand that the Department does not provide insurance cover for any of the activities listed on the website, including any activities associated with the Walking School Bus program.

Duty of Care to Students

  1. Teaching staff and/or parents and guardians take full responsibility and have a duty to take reasonable care for the safety and welfare of students whilst students are involved in school activities or are present for the purposes of a school activity related to the Your Move website.

  2. The duty is for teaching staff and/or parents and guardians to take such measures as are reasonable in all the circumstances to protect students from risks of harm that reasonably ought to be foreseen. This requires not only protection from known hazards, but also protection from harm that could foreseeably arise and against which preventative measures can be taken.

  3. When non-teaching staff, volunteers and external providers agree to perform tasks that require them personally to care for students (in the absence of a member of the teaching staff), they also owe a duty to take such measures as are reasonable in all the circumstances to protect students from risks of harm that reasonably ought to be foreseen.

  4. In satisfying the duty of care owed to students, teaching staff must exercise their professional judgement to achieve a balance between ensuring that students do not face an unreasonable risk of harm online, encouraging students' independence and maximising learning opportunities.

Victimisation

  1. I will not to use the Your Move website platform for inappropriate or illegal purposes, including posting rude, suggestive or reproachful comments to other users in order to abuse and/or harass them.

  2. I will not actively promote violence or extreme hatred against individuals or groups, on the basis of race, national or ethnic origin, religion, disability, gender, age, veteran status, or sexual orientation.

Offensive material

  1. I will not post links to other websites which contain inappropriate or illegal content or are otherwise inappropriate for people under the age of 18.

Reputational risk

  1. I will not post disparaging or overly negative comments about the Department, the State Government of Western Australia, individuals or organisations employed or otherwise working for the Department or the State Government of Western Australia.

User accounts

  1. Your Move usernames are for the use and enjoyment of our users and for others to discover you on the site. I will not share, squat, hoard, collect, trade, or sell usernames to other people.

Personal Injury

  1. I will ensure that I and others in my organisation follow occupational health and safety laws when undertaking any activity associated with the Your Move website the program, or using an item received from the Your Move program in order to avoid injury while using such item.

  2. The Department reserves the right to modify any and all individual or organisation point balances, including accreditation levels, associated with the Your Move program.

  3. The Department reserves the right to alter the points cost of any and all shop items available through the Your Move program without notice.

Report inappropriate content

If someone makes an inappropriate comment or post on the Your Move online community you can report it, even from a mobile device. Your Move has clear content policies that explain what is and isn't appropriate to do or say on the website, so if you see content or behaviour that violates our policy, you can report it to us for review. We make an effort to follow up and review reported content or behavior as soon as possible and we may remove offending content and limit or shut down the accounts of users who violate our policies.

For community organisations and businesses using images of children or young people, quality online practices begin with the ethical production of visual recordings. This means gaining the consent of the child or young person and their parent or guardian prior to recording or producing images of children or the subsequent display or distribution of that photo or visual material.
